REALE VIDA Y PENSIONES, S.A. DE SEGUROS is a company whose registered office is located at Calle Príncipe de Vergara No. 125, 28002 in Madrid, bearing Company Tax Code A85877066. This company is registered in the Companies Register of Madrid, volume 27,423, Section 8 of the Companies Book, Folio 88, page M-494230, 1st entry, as well as being featured in the Insurance and Reinsurance Entities Register of the Directorate General of Insurance and Pension Funds as an authorised institution to operate in Spain under code C-0784.
REALE SEGUROS GENERALES, S.A. and REALE VIDA Y PENSIONES, S.A. (hereinafter jointly referred to as REALE), are insurance companies that carry out insurance distribution activities.

2. Purpose and scope.

2.1. The Web Page or Website has been set up by REALE to allow anyone who is interested in doing so to access and safely perform the following actions online: search for information, pricing and contracting of the products or services offered, as well as the subsequent management of certain aspects of the contractual relationship once the client has contracted products or services offered by REALE.
2.2. Accessing, navigating and using the Website entails and implies acceptance by the user of this Legal Notice and the Terms and Conditions of Use that it includes. In this respect, "User" shall be understood as the person who accesses, browses, uses or participates in the services and activities, both free and subject to payment, available on the Website.
2.3. The purpose of this Legal Notice is to regulate access, browsing and use of the Website. Nevertheless, REALE may establish certain specific conditions to regulate the pricing and/or contracting of specific products or services offered to Users through the Website. Before using, pricing and/or contracting said specific products or services offered by REALE, the User must carefully read the specific conditions created, where appropriate, for this purpose by the Company.

3. Access.

3.1. Access to the Website by Users is free.
3.2. It is prohibited for minors to access the Website, unless they have prior and express consent from their parents, guardians or legal representatives, who will be considered responsible for the acts carried out by the minors under their care, in accordance with current regulations. In any case, it will be presumed that any access made by a minor to the Website is done with the prior and express consent of their parents, guardians or legal representatives.
3.3. Accessing and browsing the Website does not require registration; however, to undertake pricing and/or contracting actions, it will be necessary to process certain personal data, which requires the user to have accepted the Privacy Policy that has previously been made available to the User in a clear and easily accessible manner.

4. Intellectual and industrial property rights.

4.1. REALE is the owner of or has obtained the corresponding licence over the rights to exploit the intellectual and industrial property rights on the Website, as well as the intellectual and industrial property rights for the content, services and products available thereon. In no case will it be understood that accessing and browsing the Website or purchasing the REALE products offered through the Website implies any waiver, transmission, licence or total or partial transfer of said rights by REALE.
4.2. Consequently, it is not allowed to remove, evade or manipulate the copyright notice or any other information identifying the rights of REALE or its owners included in the Contents and products, as well as the technical devices for protection, digital fingerprints, watermarks or any information and/or identification mechanisms that may be contained therein.
4.3. All intellectual and industrial property rights are reserved and, in particular, it is forbidden to modify, copy, reuse, exploit, reproduce, transform, publicly disclose, make second or subsequent publications, upload files, send by mail, transmit, use, process or otherwise distribute all or part of the Content and products included in the Website for public or commercial purposes without express written permission from REALE or, as appropriate, from the owner of the corresponding rights.

5. Using the website.

5.1. The contents and products offered through the Website are only provided to end users. Any unauthorised commercial use or resale is strictly prohibited without prior authorisation in writing from REALE.
5.2. The User is responsible for accessing, browsing and using the Website; therefore, the User undertakes to diligently and faithfully observe any additional instructions given by REALE or by persons authorised by REALE regarding the use of the Website.
5.3. The User undertakes to use the contents in a diligent, proper and lawful manner and, in particular, to abstain from:
Using the content for purposes contrary to the law, morals, generally accepted proper conduct, or public order.
Reproducing, copying, distributing, permitting public access through any form of public communication, transforming or modifying the contents, unless authorisation has been obtained from the relevant copyright holder or unless legally permitted.
Using the contents and particularly any information obtained through the web page or services to send advertising, notices for direct sales or for any other commercial purpose, unsolicited messages addressed to a number of persons regardless of their purpose and to refrain from marketing or disclosing said information in any way.

6. Communications licence.

6.1. In the event that the User sends information of any kind to REALE through the Website, using the channels provided for this purpose, the User declares, guarantees and accepts that they have the right to do so freely, that said information does not infringe any third party rights, that it is not confidential and that it is not harmful to third parties.
6.2. The User acknowledges that they assume responsibility for and absolve REALE of any responsibility for any communication made by them personally or on their behalf, with said responsibility covering, without any restriction whatsoever, the accuracy, legality, originality and ownership of same.

7. Responsibilities and guarantees.

REALE does not guarantee or assume any responsibility for: (i) the continuity of the contents on the Website; (ii) the absence of viruses and/or other harmful components on the Website or on the server that supplies it; (iii) the invulnerability of the Website and/or the impregnability of the security measures adopted thereon; (iv) any self-damage or third-party damage caused by a person who infringes the conditions, rules and instructions that REALE establishes for the Website or who violates the security systems on the Website. Nevertheless, REALE declares that it has taken all necessary measures, within its capabilities and given the state of the art, to guarantee the operation of the Website and to avoid the presence and transmission of viruses and other harmful components to Users.

8. Links

8.1. Links on other web pages to the Website. Any User, entity or website wishing to establish any kind of link to the Website must comply with the following conditions:
The link can only be directed to the Website's Home Page, unless expressly authorised in writing by REALE.
The link must be absolute and complete, i.e. it must take the User to the URL address of the Website in a single click and must include the full screen of the Website's Home Page. Under no circumstances, unless expressly authorised in writing by REALE, may the website containing the link reproduce the Website in any way, include it as part of its website or within one of its frames, or create a browser on any page on the Website.
No declarations whatsoever can be made on the page housing the link stating that REALE has authorised said link, unless REALE has done so expressly and in writing. If the entity that links from its own page to the Website wishes to correctly include on its website the brand, name, commercial name, sign, logo, slogan or any other identifying element of REALE and/or its Website, it must have obtained express written permission beforehand.
REALE does not authorise links to the Website from any websites containing material, information or content that is unlawful, illegal, degrading, obscene or generally contrary to moral, public order or generally-accepted social standards. REALE does not have the power or human or technical means to know, control or approve all the information, contents, products or services provided by other websites that have established links to the Website. REALE does not assume any responsibility for any aspects related to the web page that establishes a link to the Website, including, but not limited to, its operation, access, data, information and files, the quality and reliability of its products and services, its links and/or any of its content, in general.

9. Duration and modification

9.1. REALE may fully or partially modify the terms and conditions stipulated herein by publishing any changes in the same way as this Legal Notice appears or through any type of communication addressed to Users.
9.2. Therefore, the validity in time of this Legal Notice coincides with the period of time it is displayed, until such time as it is totally or partially modified, at which point the modified Legal Notice will come into effect.

10. General

10.1. The headings of the clauses are for information purposes only and they do not affect, qualify or broaden the interpretation of the Legal Notice.
10.2. In the event of an inconsistency between the provisions of this Legal Notice and the specific conditions of any given service, the latter will prevail.
10.3. In the event that any provisions of this Legal Notice were to be ruled totally or partially null and void or inapplicable by any Court, Tribunal or any other competent administrative body, such ruling shall not affect the other provisions of the Legal Notice.
10.4. Should REALE not exercise or execute any rights or provisions contained in this Legal Notice, this will not constitute a waiver of such rights or provisions unless specifically agreed to and acknowledged in writing by REALE.

11. Complaints procedure

11.1. REALE has a Customer Care and Protection Service located at Calle Príncipe de Vergara No. 125, 28002 in Madrid, whose email address is serviciodeatencionydefensa.clientes@reale.es. Written Complaints or Claims may also be submitted to Via Augusta 258, 1º, 08017 in Barcelona. A free helpline is also available on +34 900 211 021.
The mission of this Department is to deal with and resolve complaints and claims made by individuals or companies that are users of REALE's services, provided said complaints and claims refer to their legally recognised rights and interests resulting from contracts, regulations on transparency and customer protection, or the good practices and customs of the insurance sector. Complaints and claims may be submitted in person at any REALE office that is open to the public. Complaint and claim forms are available from all REALE offices. In addition, complaints may be sent by certified post to the REALE Customer Care and Protection Service at the aforementioned address, using the same forms indicated above, or by email, in which case an electronic signature must be attached pursuant to the Electronic Signatures Act 59/2003 of 19 December.
The Customer Care and Protection Service must resolve the Complaint or Claim within the time set out in the Regulation.
11.2. If you do not agree with the decision made by the Customer Care and Protection Service, your claim can be processed, on appeal, by the Customer Ombudsman, at C/ Marqués de la Ensenada nº 2, 3ª Planta, 28004 Madrid, Fax No. 91 308 49 91, email reclamaciones@da-defensor.org, or before the Claims Service of the General Directorate of Insurance and Pension Funds, an entity belonging to the Ministry of Finance, Industry and Competitiveness, located at Paseo de la Castellana 44, 28046 in Madrid, www.dgsfp.mineco.es/reclamaciones/index.asp; alternatively, you may file a claim in the civil courts.

12. Jurisdiction

The relationships established between REALE and the User will be subject to the terms of the applicable legislation currently in force and the competent jurisdiction. However, in cases where the regulations provide for the possibility of the parties submitting to a specific jurisdiction, REALE and the User, expressly waiving any other jurisdiction that could correspond to them, shall refer any disputes or litigations to the courts and tribunals in the city of Madrid.
